Terms of Service
These Terms of Service ("Terms") govern your use of Spellrun (the "Game"), a multiplayer typing game operated by Zekiserv ("we," "us," or "our"), available as a mobile application and in the browser. By playing the Game, creating an account, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the Game.
Our Privacy Policy explains how we handle your information and forms part of these Terms.
Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Game. If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian who agrees to these Terms on your behalf.
Your Account
You can play as a guest, or create an account with an email address and password, or by signing in with Google or Discord. Guest profiles are temporary and inactive ones are removed automatically after 14 days; progress attached to a guest profile is not guaranteed to persist.
- You are responsible for keeping your credentials secure and for activity that happens on your account.
- Accounts are personal. Do not sell, rent, share, or transfer an account to anyone else.
- Usernames must be 3–15 characters using letters, numbers, or underscores.
- Do not choose a username that impersonates another person, a Zekiserv staff member, or a brand, or that is obscene, harassing, or otherwise offensive. We may reset a username that breaks this rule.
Tell us promptly if you believe someone else has accessed your account.
Fair Play
Spellrun is a competitive game with a shared ranking ladder, and it only works if results are earned. You agree not to:
- Use bots, macros, auto-typers, key-replay tools, scripts, or any software that plays the Game or types for you;
- Modify, decompile, or tamper with the Game client, or send altered or forged data to our servers;
- Exploit a bug, glitch, or configuration error to gain an advantage instead of reporting it to us;
- Deliberately lose, collude with other players, or use additional accounts to manipulate ratings or matchmaking;
- Interfere with our servers or other players' ability to play, including by flooding, denial-of-service, or abusing rate limits; or
- Access non-public parts of the Game, including administrative tools, without authorisation.
Race distance, finish order, placement, and rating are determined by our servers. Where we find that results were obtained in breach of this section, we may correct or reset ratings and statistics, remove entries from the ladder, suspend matchmaking access, or terminate the account.
Purchases and Subscriptions
The Game is free to play. We also offer paid options that remove advertising, sold either as a recurring subscription (monthly or yearly) or as a one-time purchase that does not expire.
- Billing is handled by the platform store (such as Google Play), not by us. Prices, taxes, and currency are shown by the store at the time of purchase.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time through your store account; cancellation takes effect at the end of the current period and does not retroactively refund it.
- Refunds are governed by the store's policy. We do not process payments and generally cannot issue refunds directly, though you are welcome to contact us and we will help where we can.
- If a subscription lapses, expires, or is refunded, the ad-free entitlement ends and advertising resumes.
Advertising
Unless you hold an ad-free entitlement, the Game displays advertising supplied by third parties. We do not control and are not responsible for the content of third-party advertisements or the products and services they promote.
Ratings, Ranks, and In-Game Items
Ratings, ranks, statistics, cosmetic items, and any other in-game content are part of a licence to use the Game. They are not your property, have no monetary value, cannot be exchanged for money or anything of value outside the Game, and may not be sold or traded. We may adjust, reset, or remove them where required to run the Game fairly, including at the start of a new competitive period.
The Game Will Change
Spellrun is actively developed and balanced. Gameplay values — running speed, streak thresholds, spell behaviour, rating rewards, matchmaking, word lists, and similar — are tuned regularly and may change without prior notice. Features may be added, altered, or removed, and we may suspend or discontinue the Game or any part of it. We will give reasonable notice of a permanent shutdown where it is practical to do so.
Availability
We aim to keep the Game available and fair, but we do not guarantee uninterrupted or error-free service. Maintenance, updates, network conditions, and events outside our control can interrupt play, and matches in progress may be lost.
Intellectual Property
The Game, including its code, artwork, audio, design, and the Spellrun and Zekiserv names and logos, is owned by Zekiserv or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Game for your own non-commercial entertainment. All rights not expressly granted are reserved.
You may capture and share screenshots and video of your own play, including on monetised channels, provided you do not present the material as official and do not use it in a way that is misleading or damaging to us.
Feedback
If you send us suggestions or ideas about the Game, you grant us permission to use them without obligation, compensation, or confidentiality. Please do not send us anything you consider confidential or proprietary.
Suspension and Termination
You may stop using the Game at any time and can delete your account from inside the Game, which removes your account and its race history from our servers as described in our Privacy Policy.
We may suspend or terminate access to the Game where you materially breach these Terms — particularly the Fair Play section — or where we are required to by law. Where it is reasonable to do so, we will tell you why. Deleting or losing access to an account does not entitle you to a refund of amounts already paid, except where required by law or the store's policy.
Disclaimers
The Game is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes or limits rights you have under consumer protection laws that cannot be excluded or limited by agreement.
Limitation of Liability
To the fullest extent permitted by law, Zekiserv will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost in-game progress, ratings, or items, arising from or relating to your use of the Game. To the fullest extent permitted by law, our total liability for any claim relating to the Game is limited to the greater of the amount you paid us for the Game in the twelve months before the claim, or ten United States dollars (US$10).
Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of law rules, and the courts of the Philippines will have jurisdiction over any dispute, except where mandatory law in your country of residence gives you the right to bring proceedings elsewhere.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If changes materially affect your rights, we will provide additional notice within the Game or on this page. Continued use of the Game after changes become effective constitutes acceptance of the updated Terms.
